Terms of Service

These Terms of Service ("Terms") are an agreement between you and Cardable ("Cardable", "we", "us") covering your access to and use of the Cardable website, applications, APIs, hosted card pages, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.
1. Accounts
You must be at least 16 years old to create an account. You are responsible for the accuracy of the information on your account, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly at [email protected] if you believe your account has been compromised.
2. Your cards and your content
You own the content you publish on your cards — your name, photo, title, contact details, links, media, and branding ("Your Content"). You grant Cardable a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and improve the Service, including generating QR codes, wallet passes, vCard files, and publicly accessible card pages at your chosen URL.
Card pages are public by default. Anything you place on a card can be viewed, saved, and shared by anyone who has the link or scans the code. Do not publish information you are not comfortable making public.
3. Acceptable use
- Do not impersonate another person, company, or brand, or publish contact details you are not authorized to share.
- Do not use the Service for unlawful, deceptive, fraudulent, or harassing purposes, or to distribute malware or phishing links.
- Do not use captured lead data for unsolicited bulk messaging in violation of anti-spam law (including CAN-SPAM, CASL, and GDPR marketing consent rules).
- Do not scrape, resell, or systematically harvest card pages or contact data from the Service.
- Do not attempt to circumvent rate limits, plan limits, authentication, or security controls.
We may suspend or terminate accounts that violate this section, and may remove cards that are unlawful or that are the subject of a valid impersonation complaint.
4. Plans, billing, and renewals
The Free plan is offered at no charge and may change or be discontinued. Paid plans (Pro and Teams) are billed in advance on a monthly or annual cycle through our payment processor and renew automatically until cancelled. Teams plans are billed per active seat; adding seats mid-cycle results in a prorated charge.
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and paid features remain available until then. Except where required by law, fees already paid are non-refundable. Prices may change with at least 30 days' notice before your next renewal.
If a payment fails, we may downgrade your account to the Free plan. Cards above the Free plan limits may become unavailable until the account is brought current — we do not delete your data solely because of a downgrade.
5. Team and enterprise accounts
An organization administrator can create, edit, brand, transfer, suspend, and delete cards belonging to members of that organization, and can access analytics and captured leads associated with those cards. If you join an organization with an account you created yourself, that account and its organization cards come under the administrator's control. Enterprise deployments may be governed by an additional order form and data processing agreement, which prevails over these Terms where they conflict.
6. Physical products
NFC cards and other physical accessories, where offered, are sold separately from subscriptions. They ship subject to availability and are covered by the return policy stated at checkout. A physical product does not include or guarantee any paid subscription tier.
7. Intellectual property
The Service, including its software, templates, and marks, remains the property of Cardable and its licensors. You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law. Removing Cardable branding is a paid-plan feature and not a transfer of any rights.
8. Third-party services
The Service integrates with third parties such as payment processing, cloud hosting, email delivery, wallet pass issuance, and CRM systems. Your use of those integrations is also subject to the third party's terms, and we are not responsible for their acts or omissions.
9. Availability and support
We aim for high availability but do not promise uninterrupted service on Free, Pro, or Teams plans. Service level commitments, if any, apply only where stated in an enterprise order form. We may modify or discontinue features with reasonable notice.
10. Termination
You may delete your account at any time. We may suspend or terminate access for a material breach of these Terms, for non-payment, or where required by law. On termination, your card pages stop resolving and your data is deleted or anonymized in accordance with our Privacy Policy retention schedule. Export your contacts and analytics before you delete your account.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, Cardable will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or USD 100.
13. Indemnity
You will indemnify and hold Cardable harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law — including claims relating to contact data you collect through lead capture.
14. Changes to these Terms
We may update these Terms. If a change is material, we will give notice by email or in-product at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules, and the state and federal courts located there have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.
